Unfortunately, the Scottish Government yesterday announced their plan to introduce a deposit Scheme in Scotland.
SAL have fought against this and along with some other organisations have expressed disappointment about the decision. Last night, John Blackwood of SAL was busy sending out a press release and here is the BBC picking up on it:

Concern over Scottish Government’s Tenancy Deposit Scheme Plans

The Scottish Association of Landlords (SAL), the Scottish Rural Property and Business Association (SRPBA) and the Chartered Institute of Housing Scotland (CIH) have expressed their disappointment that, despite continued opposition from their organisations, the Minister for Housing and Communities has announced that a national mandatory tenancy deposit scheme is to be introduced.

John Blackwood, Director of SAL, said

“We continue to feel that the introduction of a scheme is disproportionate to the level of problem which exists. We are not denying that tenancy deposits are unlawfully withheld in some cases, just as in some cases the deposit does not cover the costs of repairing damage caused by the tenant. We have maintained our opposition to the introduction of the scheme throughout the working group discussions, and although we tried hard to get other members to consider alternative methods of addressing the problem, we acknowledge we were fighting a losing battle.”

The SRPBA share SAL’s position and Sarah-Jane Laing, SRPBA’s Acting Head of Policy stated,

“We are naturally disappointed that further regulation is being placed on the sector, despite our best efforts to get other stakeholders to consider addressing the tenancy deposit issue through other routes, such as the Private Rented Housing Panel (PRHP). It would be very easy to walk away from the working group process as a result, but we are committed to working with the Scottish Government to develop the details of the scheme, and ensuring that landlords’ interests are at least considered.”

Sue Shone, Policy and Practice Officer with CIH Scotland said

“CIH is very concerned that Scotland will follow England’s approach of a mandatory scheme, this has yet to be evaluated for effectiveness and value for money. In a time of great financial pressure and the unprecedented commitment to end homelessness it seems bizarre that the Scottish Government is willing to invest in a system that may provide barriers to private landlords entering the market but is not proven to be the most effective way to protect tenancy deposits.”

Like you I was helping Allan, my youngest son to look for a rental property in Edinburgh and was totally disgusted and flabergasted by the standard of properties, lack of adherence to legislation and rogue landlords and appauling letting agents in the city. One arranged for us to view a property and when we arrived there a tenant was already in situ who had just moved in 2 weeks previously......and I had driven up from Kelso to look at it with him. Another was advertised as "refurbished....must be seen" again I drove up to look at it with him and it was disgusting and had never seen a paintbrush let alone a cleaner in the last year or two at least!!

Eventually we did get him a decent flat which in fact is owned by an Edinburgh solicitor personally, what a joke the paperwork he produced, not a registered landlord and I needed to keep him right on the safety checks, EPC etc he needed to get carried out!!!! How are they getting away with it???!!!

All in all I felt so good about my own Letting Agency......proved to me that we are streaks ahead of the City in the standard of properties we offer, effeciency of service provided to landlord & tenant and making sure all our paperwork, leases, safety checks etc etc are in order.

Claremont Properties launched in Edinburgh a few months ago adding to the already great reputation that we have in the Borders and know we can offer a better service in Edinburgh than exists there at present......how they are getting away with it beggars belief!!!

So I would like to recommend my own agency to anyone looking for a good agent in Edinburgh!!!!"

I concur with your thoughts on the poor service that letting agents offer to both landlords and tenants and we constantly hear horror stories from both parties of how lazy/greedy agents just do not seem to care.

This leads to the industry getting a bad name.

"Great to get another invaluable newsletter. I read with interest (but no surprise) about yours and others experiences of Private Landlords and Letting agents.

I run Click-Let Ltd, based in Edinburgh with around 460 properties. I believe that we deliver an excellent service to both Landlords and tenants, everything is by the book.

From a tenant perspective we retain very few deposits and where these have been disputed we refer the tenants to the private rental sector in Edinburgh Council. We have never been told that we have unfairly withheld any funds.

From a Landlord point of view we track the reason for every Landlord leaving us and in less than 5% of cases is it because they feel that they have had a poor service. In most of these cases I could happily discuss each case with an independent person and strongly believe that we would be considered not to be at fault. All this for an unbelievable Mgt fee of 9.75% + VAT. I have a fantastic team of well trained, motivated and capable staff of whom I am very proud. Why not give us a try :-)

Last month, 10 students completed the TICN-MMCP (Making Money with Careful Planning) course in Edinburgh with 6 new members undertaking the course this weekend at the Marriott Hotel (I think we should buy shares in the Marriott Group)!!

There will be an informal club meeting next Tuesday evening (22nd) to allow everyone to get to know each other better and to review what we have all learned about the stockmarket so far.

The Club Membership is restricted to 19 so if you are seriously considering getting into the Stock Market, then I recommend that you do this within the safety of an Investment Club until such times as you feel confident about trading alone.

Holyrood’s programme for Scotland 2009-2010

The Scottish Government's programme for Scotland 2009-2010, “Towards a More Successful Scotland”, has been published. The document sets out the legislation for the coming year, as well as summarising the key achievements and main goals for the future.

The 13 proposed bills for this parliamentary session contain proposals which will impact on property businesses in the following areas:

Alcohol control;

The construction of the new Forth Crossing;

The end of the right-to-buy for all new social housing;

The setting of efficiency targets for Scotland to reduce energy consumption in homes and commercial properties.

An article in last Tuesday's Metro caught my eye... The headine "Soldier's family row over 'lost' will" made me think about the service provided by my guest speakers for next month's event. The family of a soldier killed in Afghanistan are locked in a legal dispute with his fiancee over the fallen corporal's estate. Rob Deering, 33, was killed by a booby trap in Helmand province in December last year while serving with the Commando Logistic Regiment. After his death, his fiancee claimed he had made a new will leaving his estate, including the house and a life insurance policy to cover the mortgage, to her. The deceased soldier's sister, however, claimed that he had left his inheritance to her. Read the full story here...
